Real Estate Standards of Care

The legal term “Standard of Care” is of significant interest to home buyers and sellers. Realtors take classes to avoid lawsuits for practicing law and practicing real estate outside of their areas of expertise. Construction and technical building issues are outside of a Realtor’s area of expertise.

In continuing education classes about “How To Avoid Being Sued,” agents are taught to refer clients to an expert. Agents are told to avoid giving technical opinions or advice.

99% of Realtors in Las Vegas will not give you their opinion or advice about housing construction issues. CE classes say to never point out red flags, and if brought up, refer the client to an expert.

Since Kurt is a former Nevada Building Engineer whose specialty was “wood-framed structures” he is an expert. If sued and Kurt failed to point out a red flag that he saw, he would probably lose. Therefore, they’ve embraced helping all clients – “it’s the right thing to do.”

When viewing resale homes for sale with you, they want you informed about visible flaws or potential red flags. While walking through houses, they’ll point out bowed walls, signs of water damage, drywall issues, etc., that they see. Outside they may point out some rust in the pool, drainage issues, and even pigeon nests.

When representing sellers, Kurt and Terri know the market, home values, loans programs, and statistics. Very few Realtors view more properties each month than they do. More importantly, they know every buyer “out clause” and typo in the standard Board of Realtor contract. They reference them on counter-offers to protect their sellers. They close loopholes.

While listing a 4-year-old house, Kurt walked past a grandfather clock in an upstairs hall. The clock moved slightly. Together with the sellers, he contacted the builder, and they all met. It turned out that the framers used a different thickness of plywood than the plans specified.

The entire upstairs wood floor and all carpet and tile were replaced as a warranty item. That was a safety item, and if anything happened after selling the home, it could have come back on them. Would the builder have covered that costly fix if the house was out of warranty? Hmmm.

Every new construction buyer is gifted a new construction home inspection because it’s important to test new technology materials. At closing, they gift a resale buyer with an inspection too. Ever since Kurt and Terri met in 1994, on Sundays they watch 2 NFL teams. These developed into whoever Kurt chose that week and the Oakland Raiders.

Terri, a native Californian, lived in Los Angeles for the 12 years that the Raiders were there. She talked about the Raiders moving to Vegas for years – about going to games and how much fun they’d have.
